"At Will" Employment

employment at will mason ohioThe notion that Ohio's doctrine of an "at will" employee eliminates an employee's right to dispute a wrongful discharge is inaccurate.

Although Ohio recognizes the common law "employment-at-will" doctrine (the general rule that employees can be fired with or without cause) the rule is limited by the numerous statutory and case law exceptions.   

In other words, numerous Federal and State statutes effectively override this doctrine.  Title VII of the Civil Rights Act of 1964 which prohibits employment discrimination on the basis of race, color, sex, relatigion and nation original; The Age Discrimination in Employment Act, The Equal Pay Act, The Americans with Disability Act and the Fair Labor Standards Act are just a few laws that provide employee's with protection from illegal or unfair employment actions.  

Ohio also has a number of statutes that extend rights to employees similar to those provided by Federal law.  Moreover, Ohio recognizes public policy exceptions to the "at will" employment doctrine.  Employees who believe that that have been wrongfully terminated, or discriminated against in the workplace may be entitled to compensation and should contact counsel.
